Harper Plus.App Terms Of Service
Welcome to Harper Plus, including our CRM and automation solutions offered under the name Harper Plus App. These Terms of Service ("Terms") govern your access to and use of our services, all provided by Harper Plus ("we," "us," or "our"). By using our services, you agree to these Terms. If you do not agree, please refrain from using our services.
1. Services Provided
1.1. Harper Plus is a comprehensive digital marketing and CRM solutions provider specialising in automation systems, CRM, and sales systems.
1.2. Harper Plus App is a CRM and sales automation solution provided by Harper Plus, offering tools for marketing automation, lead generation, customer relationship management, and more, hosted on the HighLevel platform.
1.3. HighLevel Platform: We utilise the HighLevel platform to build, support, and deliver our marketing automation and CRM systems. When using features integrated from HighLevel, their terms and policies also apply.
2. Account Registration
2.1. To use Harper Plus App, you may need to create an account. You agree to provide accurate, up-to-date information during registration and to maintain the security of your login credentials.
2.2. You are responsible for all activity on your account and for maintaining confidentiality.
3. Use of Services
3.1. You agree to use the services provided by Harper Plus, including the Harper Plus App, in compliance with all applicable laws and these Terms.
3.2. Unauthorised uses, including reverse-engineering, modifying, or misusing our services or content, are prohibited.
3.3. Third-Party Platform: Since Harper Plus App operates on the HighLevel platform, you are also bound by HighLevel’s terms of service: https://www.gohighlevel.com/terms-of-service.
4. Service Fees and Billing
4.1. Subscription Fees: Harper Plus App operates on a subscription basis. You agree to pay the fees as outlined in your plan, which may include monthly or annual charges.
4.2. Additional Services: We offer add-on services, including consultation, technical setup, and custom implementations, which may be billed separately as outlined in your service agreement.
4.3 Usage feature fees: Usage fees are applicable when using HighLevels marketing and AI features, which includes: SMS, Email, AI Automations, and additional add on features. Usage fees are tracked and invoiced the following month.
4.4. Payments are non-refundable unless otherwise specified.
5. User Responsibilities
5.1. Prohibited Content: You agree not to use our services to upload or distribute content that is illegal, harmful, offensive, or infringes on the rights of others.
5.2. Compliance: You are responsible for complying with all applicable data protection and privacy regulations when using the CRM for customer data.
6. Intellectual Property
6.1. All content, software, trademarks, and branding remain the property of Harper Plus Limited and HighLevel, where applicable.
6.2. Users are granted a non-exclusive, non-transferable right to use the services as intended.
7. HighLevel Platform and Third-Party Integrations
7.1. Harper Plus’s Harper Plus App uses the HighLevel platform as the foundation for delivering our CRM services. HighLevel’s functionalities, policies, and limitations apply to all services delivered through the Harper Plus App.
7.2. We may provide integrations or links to third-party services, but we do not endorse, nor are we responsible for, third-party content or performance.
8. Data and Privacy
8.1. Data Collection: We collect data to deliver and improve our services. Please refer to our Privacy Policy for detailed information on data handling and your rights.
8.2. HighLevel Data Processing: By using the Harper Plus App, you understand that HighLevel may process data as required to fulfill its platform services.
9. Limitation of Liability
9.1. Harper Plus and the Harper Plus App are not liable for any indirect, incidental, or consequential damages arising from your use of the services. Our liability is limited to the extent permissible by law and only to the amount paid by you for the service.
10. Termination and Suspension
10.1. We may suspend or terminate your access to our services if you violate these Terms, for any reason, or if we deem it necessary to protect the integrity of our services.
10.2. You may terminate your account at any time if your license is outside the agreed contract period.
10.3. Cancellation within the contract period will result in early termination fees, which will equal the number of remaining months left in your contract.
11. Modifications to the Terms of Service
11.1. We reserve the right to modify or update these Terms at any time. Significant changes will be communicated to users, and continued use of our services constitutes acceptance of these changes.
12. Governing Law
12.1. These Terms and any disputes arising from them are governed by the laws of New Zealand.
